MEMORANDUM DEPICTING MAIN THREE DEMANDS OF VETERANS SUBMITTED TO GOVT:Veteran Prabhjot Singh Chhatwal PLS Retd.

Dear Veterans,
Regards. I am back from Delhi, late last night. Now

the Prime Minister is on tour, abroad. We will get a

meeting fixed with him when he is back and our new

organization is registered. The much discussed

memorandum, depicting only ® only three main

and urgent demands of ex-servicemen (i.e.1.Immediate

release of Improved pension to JCOs. and below.

2.Grant of pension @ 60 % of last pay drawn to JCOs

and @ 70 % to Havs. and below.3.Change of Pay band

from PB-2 to PB-3 for Sub. Maj.and from PB-1 to PB-2 for Hav.)

stands submitted by me, after discussion with concerned

authorities, under my signature on the letter-head of my

non-controversial org. 'Indian Ex-Services League , Punjab &

Chandigarh' to avoid delay and as per the much valued

suggestios made by some of our much concerned

veterans on this blog and others who, personally,

interacted with me .

In this context, I have only ® only one information,

worth useful dissemination, that 'Change of Pay band',

asked by this organization i.e. IESL (P&C) only ® only,

much earlier and supported by none so far, has become

'Hot Topic' under discussion, both in official


circle and among the serving soldiers.

It can not ® can not be assessed, now, when Govt.

agrees to this demand but it is certain to get through,

sooner or later. The'recent committee', formed by govt.

(after joint memorandum submitted on 14-10-2009)

to review the demands of veterans, is very well aware

of this demand raised by us.

Now coming to C' Box discussion on my blog, I shall

give no comments, as my respected veterans have

discussed much among themselves, except offering

my humble suggestion to be polite and respect other's

point of view, if you wish others to do the same.

Please do not give personal comments on any one .

During my absence,, my veteran friend S.S. Sohi has

posted the posts and chatted on C'Box with my consent.

He has very clearly mentioned on the blog 'for Vet. PJS Chhatwal.


One thing, I would request my vet. friends to go through the post

showing Gulf News dt.20-11-2009 with PJS marked on it. Please

go through this carefully and find for yourself, whom my friend

Gavini addresses and suggests that this is not the way .It is also

another game played by my friends under my name like one

The Armed Forces Tribunal is now functional at Delhi, Chennai, Jaipur and Chandigarh
The Armed Forces Tribunal, which has jurisdiction over both service as well as court-martial issues concerning the three services, is now operational at Delhi, Chennai, Jaipur and Chandigarh.The Chandigarh Bench of the Tribunal was inaugurated by Justice T S Thakur, Chief Justice of the Hon’ble Punjab & Haryana High Court who is going to be elevated as a Judge of the Supreme Court today. The bench having jurisdiction over Chandigarh, Punjab, Haryana, J&K and HP was notified with effect from 16 Nov 2009.A comprehensive news-report on the same can be accessed by clicking here.It was also a good day for civilian retirees. The applicability of a new stipulation on encashment of leave has been taken back to 01 Jan 2006 instead of the earlier cut-off date of 01 Sept

Comments of Union Law Minister.Veteran Prabhjot Singh Chhatwal PLS Retd.

Law Minister re-emphasises that Govt would soon be a ‘responsible’ and ‘reluctant’ litigant
As this news-report would signify, sometimes our Hon’ble Courts are burdened with unnecessary litigation. Filing of cases and appeals, especially in employee and pension related matters, becomes more of a power-ego-play for departments rather than a vehicle of justice. Serving and former staff members of govt related organisations who approach Hon’ble Courts for justice are often seen as enemies of the system rather than aggrieved persons seeking application of the principles of fairness.With this background, the speech of our Law Minister in the recently concluded ‘All India Conference of the Central Administrative Tribunal’ comes as a welcome step. Here are a few excerpts from the same :“…You must be aware that we are progressing towards bringing judicial reforms. One of the agenda before the Government is that we want to remove the tag of 'biggest litigant'. We are formalizing the policy of Government litigation. We are collecting data from all the Departments of the Government regarding cases pending in the Courts and Tribunals. We will analyze those cases and take necessary corrective steps. Our efforts are that Government should go in litigation only where it is necessary. Unnecessary appeals should not be filed on behalf of the Government. Soon we will formalize our policy…”“…The Central Government is proposing the introduction of a litigation policy. The government is to be transformed from a compulsive litigant into a responsible and reluctant litigant. An action plan in this behalf will be launched separately. It has a two pronged approach - identifying and removing ‘useless’ cases which are burdening the docket. This should be done at the earliest…”“…The present system viz ‘let the Tribunal decide every case’ must be eliminated. Setting up of Empowered Government Committees to eliminate unnecessary litigation need to be considered…”
A very good approach indeed. Hope it translates into action on the ground !

Process of drafting Memorandum of Association Started today: Veteran Prabhjot Singh Chhatwal PLS Retd.

Dear Veterans,
Regards. As being pressed by many veterans,

it is decided to start the process of drafting the

Memorandum of Association for the new

organization which, we all, have thought over.

The association will be named as,

All India Ex-Soldiers, Sailors and Airmen Association

and got registered at the ealiest.

Now I would request all those interested veterans who would like

to be associated with the Association as Founder Members and

as Office Bearers, such as State Presidents,

Distt. Presidents should post their particulars in the comment

column of this post as follows.

Fate of OROP as promised by Govt of India (Based on CoS Report): Veteran Prabhjot Singh Chhatwal PLS Retd.

Dear Veterans,
Regards. In response to repeated enquiries being made by veterans, it is intimated that OROP (in fact improved pension), which the govt. promised to Sub Maj. and below, is being delayed, further, because of Joint Memorandum submitted by IESL,IESM, Retired Defence Officers Association and Naval Foundation. Since in their joint memorandum, these organizations had rejected the Govt's offer of OROP based on CoS report and suggested their own version of OROP, the govt., having got the leverage to delay further the discharge of their responsibility of payment, promised to review the report. Other wise, the veterans would have, definitely, got the improved by this time. Still the orders for the release of improved pension are expected any time. Let us wait for some more time.

Tricky Game Played By Big Brothers in Absentia

Regards. Please find below the complete facts about tricky game played by Big Brothers

Tricky game played by some Big Brothers in Absentia.

Dear Veterans,
Regards. I do not nurse the habit of arguing with my comrades -s in- arm but always counter injustice we face at the hands big Brothers. In this particular case I am compelled by my conscience to place the facts in order. The particular person who chatted yesterday ( 10-11-2009) under the name of S. Singh is a fake identity (Ploy) planted by those who do not want JCOs. and below to get what ever small the Centre Govt. wants to give us as a result of CoS report, though in garb of ONE RANK ONE PENSION. These big brothers fear that if we get that, we will not fall in at their call when they want to show their number to the govt .to pressurize it. Every one is aware that it is not ONE RANK ONE PAY but IMPROVED PENSION. This S. SINGH was never seen chatting earlier on this C' Box . Even Vet. Gavini has pointed out this fact at 18.46 hrs.
The same person has earlier appeared, as Anonymous, in comments column on Vet. Gavini's blog under my article, Let the JCOs. and below get some thing which Vet. Gavini posted on 06-11-2009. You all must go through his comments. In his first comment he showed sympathy with our cause and suggested that some veterans should sacrifice and then the govt. will give us some thing. He was given a reply by me in very polite words. In his second comment he changed his colour and talked other way. When he got a befitting reply from me, he just vanished for two/ three day and suddenly appeared on Vet. Gavini's C' Box on 10-11-2009 when I gave the news to veterans that I have contacted PM office and we will get appointment fixed to meet PM between 15-11-2009 to 20-11-2009.
During his chat he spoke much against me and other veterans posing such questions as if he is well informed person, thinking himself 'a figure among ciphers' and sympathized and then provoked Vet. Gavini to great extant resulting into Gavini's out burst against me continuously for which I do not ( R) not blame Vet. Gavini at all. His out burst was totally due to provocation by the ploy, S. Singh. During his chat the ploy criticized Vet, Raju saying that his offer of donation was tactics to collect the money from other veterans. He provoked every one and found time to suggest ( at 18.09 PM) that Gurgaon, where claimed to be residing, was best place for Hq. and the alternative place was Vet. Gavini's place i.e. Hydrabad. What a good suggestion it was but by his words he disclosed the motive of his dirty game to dislodge our plan. This is what his mentors wanted him to do.
Now ,Dear veterans we have to see through the tricks of our big brothers who never speak a word about JCOs. and below. At the same time, I do not blame our Veteran brother Gavini because all his out burst was natural and due to the provocation by said S. Singh. At the sane time, I must state here that I have explained to Vet. Gavini in my E'mail 08-11-2009 and requested him to discuss my proposal with Veterans Raju, Kannan and RKS and let me know .I clearly told him that this arrangement of making Hq.at Patiala, was till the whole structure is formed and the constitution was finalized and registered after our meeting in Patiala which was to take place on 26th January,2010. Now I would I would like to intimate my veteran brothers that our program fully stands but only thing it is delayed a bit .Rest all details will be intimated soon to the veterans. O.K.Thanks.

Earlier made on 31July,2009 to Respected Veteran (Gen.)
Satbir Singh,Vice President, IESM on IESM blog being repeated.

Dear Veteran (Gen)) Satbir Singh and others
Regards. Would you kindly allow me to comment on
your e-message?

It has been repeated,a number of times, on
IESM blog that Govt. of India has not
acceded to our demand of ONE RANK ONE
PENSION, so far.

So called announcement of grant of ONE RANK ONE PENSION
for PBORs in the Budget Speech, was in fact, implementation
of Punjab & Haryana High Court decision regarding removal
of anomaly concerning only JCOs and below which was created
(after Fifth CPC) with the issuance of Govt. letter dt. 10-10-1997
(R) 10-10-1997 and the same was not implemented so far. JCOs.
and below are well aware of it.

Secondly, grant of special grade to Lt. Gen. is to place them on
equal footing with civil officers as a result of up gradation of
Higher Administrative Grade (HAG).

A dissection Well,
The public at large has been talking of the recent sops announced
for defence pensioners. The starting point was the Union Budget
speech. The following are the major ‘steps’ that have been taken
to address the issues:
1. Bridging the gap between pre-Oct 1997 and post-Oct 1997
pensioners.
2. Removal of 33 years’ qualifying service condition for earning
full pension.
3. Grant of a separate scale for Lt Generals But the
truth is somewhat like this:
Point No 1 is a resultant of an order
of the Hon’ble Punjab & Haryana High Court which has been
upheld by the Hon’ble Supreme Court so there was no escaping
this by the Govt.
Point No 2 is a resultant of the recommendations
of the 6th CPC and the same has also been accepted for civilians,
so what extra has been initiated for faujis in this ?
Point No 3 is also a resultant of a Finance Ministry missive
by way of which the Higher Administrative Grade (HAG) on the
civil side has been upgraded to Rs. 67000-79000, something
that has been applied to our Lt Generals too in a parallel fashion.

I would again reiterate, that this play of words is the work of
some lower level spin doctors who do not let our Ministers,
Parliamentarians, top bureaucrats and top brass understand
the minute modalities of such matters. They have led the top
echelons to believe that much special has been done for defence
pensioners but the truth is quite removed from reality.
It is not an obligation that Hon’ble SC orders have been

implemented and again not quite an ehsaan that the changes
such as removal of 33 years’ service requirement for full pension
or grant of HAG, changes which as it is have been initiated in the
universal pension and pay regime, have been duly extended to
the defence services. I say it again, it’s time for the higher civilian
and military establishment to wake up before the army of promoted
lower bureaucracy takes the system and the nation for a ride.
Information which should ideally reach top political, civil and
military echelons is filtered by the heavy tentacles and thick
mesh of lower bureaucracy, a malaise which is eating into whatever
progress we are making.
There is only one answer to this: proper application of mind on file

noting and minute sheets initiated from below. Let us stop affixing
ghuggis and start imposing our grey matter on the noting of the
supervised staff.

Now Sir, when it is amply clear that an anomaly pertaining
to JCOs. And below personnel only is being removed by the
government, let it be in the garb of OROP, why should the big
brothers (who earlier acted as saviors of ex-servicemen
community) take such step to compel the govt. to shelve the
move by which JCOs and below are going to be benefited in
their pension from Rs. 1,000/- to Rs.1800/- P.M. as per their rank.

I assure you, Dear Gen, JCOs below Personnel are not (R) not
averse to demand of OROP but at the same time they can not
forego what is due to them as a result of removal this anomaly.
They will again march with you for the demand of OROP but
for, God sake, let this anomaly be removed first in the same
way as the anomalies in respect of Lt. General, Maj. General

DEMANDS OF EX-SOLDIERS,SAILORS AND AIRMEN

All India Ex-Soldiers, Sailors and Airmen Association has sought
a better deal for Havildars and Sub.Majors from the Centre Govt.
Veteran Prabhjot Singh Chhatwal PLS Retd. has asked the govt.
to change the Pay-Band for Havildars and equivalent ranks from
PB-I to PB-II and for Sub. Majors and equivalent ranks from PB-II
to PB-III since the Sixth Pay Commission has not done justice with
these ranks. Association has stress upon the govt. that the soldiers
of the rank of Havildar form the real back-bone of Defence Forces
and Sub. Major acts as a Chief executor of the strategy in the war.
These two ranks have been virtually crushed by the recommendations
of Sixth Central Pay Commission and further faulty implementation
of the recommendations regarding their pay scales. The Havildars
have been virtually equated to class-IV civilian such as Peons,
Chowkidars, Mali and Dhobi etc. in respect of pay.
Association further asked the Minister to release immediately
the orders for promised ONE RANK ONE PENSION for Junior
Commissioned Officers, Senior Non-Commissioned Officers,
Non-Commissioned Officers and other ranks which was announced
by Finance Minister in Union Budget on 6 July 2009, and then by
the Minister him self inthe Parliament and finally by Prime Minister
on Independence Day but the order regarding the same has not been
issued so far.
Association has reminded the Minister that the govt. had also agreed
to give pension to soldiers up to the rank of Hav. @ 70% and to
JCOs @ 60% of the last pay drawn to compensate for their early,
compulsory, retirement but to the great disappointment of the
soldiers, these orders have also not seen the light so far whereas
orders regarding change of Pay Band from PB-III to PB-IV for the
Lt. Col. have been issued long ago although these recommendations
were made by the same group of ministers in the same report. With
this partial treatment given to lower ranks, a great resentment is
prevailing in the Defence Forces and among the veterans which is
not good for nation’s security.
We vehemently stress upon the govt. to fulfill the demands of
veterans at the earliest lest they may come onthe roads like civilian
counter parts and the govt. will be in a critical position to handle that
volcanic situation.
Last but not the least, the we, forcefully, demand of the govt. not to
use the term PBORs for Junior Commissioned Officers, Senior
Non-Commissioned Officers, Non-Commissioned Officers and other ranks
as they feel much humiliated by being referred as such.
